Gonçalo Pinto Ferreira, partner and head of Labour and Social Security practice, comments on the changes to the Labour Code in the newspaper Jornal Económico, clarifying some issues related to work on digital platforms.
The lawyer, who specialises in labour and social security law at TELLES, explains that there are now signs of employment adapted to work on digital platforms, which could make it possible to recognise couriers as platform workers. There are two options for those interested in establishing this link: they can be represented by a lawyer and proceed with the process, or they can ask the ACT to carry out an investigation and, if such signs are found, the company can be notified to acknowledge that it is a worker," points out Gonçalo Pinto Ferreira.
He adds that "the ACT itself can initiate the process (even without a complaint from the courier), similar to what it has done with the so-called false green receipts". ACT inspectors will play a key role in the application of the new rules, particularly as couriers are to a large extent immigrants with limited resources. "It seems to me that the role of the ACT will be crucial precisely for that reason, and also because in many circumstances many of these couriers may be quite far from being aware of the potential rights that the law now gives them."
