João Dotti de Carvalho, managing associate of the Labour and Social Security practice at TELLES, signs an opinion article entitled “Use of Outsourcing Prohibited”, published in Jornal Económico.
According to the lawyer specializing in Labour and Social Security, the amendment to labor legislation that introduces a rule that prohibits companies from resorting to outsourcing appears to be “a reductive vision and that, in addition, calls into question other fundamental principles (with constitutional support ), such as the freedom and autonomy of a company’s management, which becomes even more incomprehensible in the face of the current economic context”.
“Without prejudice to waiting for the diploma to be published, once again the legislative technique will not be the best, raising several doubts, namely, whether the ban is only for essential activities or whether it also applies to ancillary activities [.. .] or even what consequences may result for the company”, says João Dotti de Carvalho.
