Gonçalo Pinto Ferreira on the Impact of Suspending the EU Minimum Wage Directive

Gonçalo Pinto Ferreira, partner and head of the Labour and Social Security practice at TELLES, comments on the national delay in the implementation of the European Directive on adequate minimum wages and its consequences.

The TELLES lawyer points out that, although Portugal could be subject to infringement procedure, "the infringement procedure has several stages and it is not immediately sent to the European Court of Justice", and warns that "at the end of the day, Portugal could be condemned to a significant fine, in addition to being obliged to fulfil its legal obligations to adapt to the directive".

Gonçalo Pinto Ferreira also arguments that “the European Union has usually taken a rather firm attitude, not only because this is not just a situation affecting the country at fault, but rather a question of balance and effectiveness in the application of European Union policies”.
