Information Note | Updates to the Portuguese Legal Framework Applicable to Renewable Energy

The legal framework applicable to renewable energy in Portugal was recently amended by Decree-Law no. 99/2024, of 3 December, which partially transposed Directive (UE) 2023/2413, of the European Parlement and of the Council, of 18 October 2023 (RED III). The new Decree-Law no. 99/2014 introduces significant changes to Decree-Law no. 15/2022, of 14 January (which establishes the organisation and functioning of the National Electricity System) and to Decree-Law no. 151-B/2023, of 31 October (which approved the Legal Framework for Environmental Impact Assessment).

TELLES' Energy & Natural Resources team, coordinated by partner Ivone Rocha, has prepared an informative note analysing the primarily impact of this legal update, namely in relation to:

  • Environmental impact assessment
  • Electricity storage
  • Hybridisation
  • Specific rules within the scope of administrative licensing procedures (including deadlines)
  • Self-consumption of renewable energy
  • The national agricultural reserve
  • Municipal contributions
  • The status of electro-intensive consumer
  • The activity of energy registration and bilateral contracting.
