João Pinho de Almeida, consultant at TELLES, clarifies doubts regarding the conditions that candidates must meet to be considered in the admission for Police Agents Training of the Public Security Police (PSP), to Polígrafo SIC.
The TELLES consultant confirms that Decree No. 143/2022 establishes that "only candidates who meet the following requirements are admitted to the selection process: not being older than 30 years at the opening of the competition." However, "in Decree-Law 76/2018, Article 36 states that 'the actual service time rendered (...) is deducted from citizens' chronological age, up to a limit of four years'" for candidates who have completed military service.
"The limit for a civilian is thirty years, while for a military candidate it is thirty-four years, because it comprises the general limit of thirty years for civilians plus the four-year deduction from their chronological age, which they are entitled to for having served in the armed forces. The law grants the right, and the decree establishes the respective limit. Therefore, the age limit is not solely determined by the competition rules but by the law itself," concludes João Pinho de Almeida.
