Gonçalo Pinto Ferreira, partner and coordinator of the Labour and Social Security Practice at TELLES, and Sara Mesquita, associate in the same practice, wrote the opinion article "If you work for us, you don't work for anyone else! Will this always be the case?", recently published in Human Resources.
The lawyers specialized in employment law at TELLES point out that “it is more than common practice in labour relationships to impose an exclusivity obligation to the employee”, but refer that “another controversial issue has yet to be resolved: should the company pay the employee a consideration for the exclusivity obligation?” They also add that “the courts have not contributed to the legal certainty and security that was needed in this matter”, thus concluding that to the question ‘can companies demand that their employees have no other activities? The answer is not always!”
